These Terms and Conditions govern your use of the quad-x.com website and your relationship with quad-x.com (Quad-X, we or us). Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not register for or use the quad-x.com Site. Please note that to use some the services provided on the quad-x.com Site, you are required to register as an authorised user on the site.

1. Use of the quad-x.com Site

The quad-x.com Site is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the quad-x.com Site you agree to be bound by these Terms and Conditions. All orders and purchases made on the quad-x.com Site will also be governed by relevant warranty Terms - please click here to see these.

THESE TERMS AND CONDITIONS DO NOT AFFECT YOUR STATUTORY RIGHTS.

2. Amendments

We may update these Terms and Conditions from time to time and any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the quad-x.com Site. If you do not wish to accept the new Terms and Conditions you should not continue to use the quad-x.com Site. If you continue to use the quad-x.com Site after the date on which the change comes into effect, your use of the quad-x.com Site indicates your agreement to be bound by the new Terms and Conditions.

3. Registration

To register with quad-x.com you must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details

4. Password and security

When you register to use the quad-x.com Site you will be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should notify us by contacting Quad-X immediately.

If quad-x.com has reason to believe that there is likely to be a breach of security or misuse of the quad-x.com Site, we may require you to change your password or we may suspend your account. Standard eCoupon Terms and Conditions

5. eCoupons

eCoupons can only be used online at www.quad-x.com subject to these general terms and conditions, and any other specific conditions notified to you on the issue of an eCoupon.

An eCoupon is redeemed by entering its code at the appropriate point in the online purchase process. Redemption may be subject to you providing proof of entitlement to use the eCoupon.

Your use of an eCoupon indicates your agreement to be bound by these eCoupon Terms and Conditions.

Quad-X reserves the right to withdraw or cancel an eCoupon for any reason at any time.

a. Distribution of eCoupons

eCoupons are, and remain at all times, the property of Quad-X.

The right to use an eCoupon is personal to the original recipient and may not be transferred. No eCoupon may be copied, reproduced, distributed, or published directly or indirectly in any form or by any means for use by an entity other than the original recipient, or stored in a data retrieval system, without the prior written permission of Quad-X.

eCoupons distributed or circulated without the written approval of Quad-X, for example on an Internet message board or on a "bargains" website, are not valid for use and may be refused or cancelled.

b. Permitted usage of eCoupons

Unless expressly stated otherwise at the time of issue of the eCoupon;

Each issued eCoupon will be valid for use by a recipient only once,
Only one eCoupon will be valid for use per customer or household, as the case may be, and,
An eCoupon may not be used in conjunction with any other special offer or eCoupon.

eCoupons cannot be exchanged for cash or used to purchase gift-vouchers.

c. Excluded goods and services

Certain goods may be excluded from eCoupon offers which will be notified to you along with the eCoupon or through the quad-x.com website.

eCoupons may be limited to redemption in respect of certain products or certain products may be excluded from the ambit of use of the eCoupon, in which case notice will be given to you at the time of issue of the eCoupon.

Excluded goods and services will not count towards any qualifying conditions for offers and will not benefit from any promotional discount.

d. Minimum spend requirements

Where the redemption of an eCoupon is subject to a minimum spending requirement, the redemption is only permitted in respect of the purchase of qualifying products which will be communicated to you at the time of issue of the eCoupon. Excluded products and supplementary charges, such as delivery, VAT, gift wrap or postage & packing, shall not count towards a minimum spending requirement.

e. Calculation of discount

Where an online offer states that a percentage discount will be given on a purchase, the cost of the qualifying purchases will be reduced by the stated discount percentage.

Where purchases are stated to be offered on a "VAT-free" basis, the prices of qualifying items will be reduced by the equivalent of VAT.

Supplementary charges such as delivery or postage & packing shall not be discounted unless specifically stated in the offer description.

f. Security and Fraud

When you use an eCoupon you warrant to Quad-X that you are the duly authorised recipient of the eCoupon and that you are using it in good faith.

If you redeem, attempt to redeem or encourage the redemption of eCoupons to obtain discounts to which you or a third party are not entitled you may be committing a civil or criminal offence.

If we reasonably believe that any eCoupon is being used unlawfully or illegally we may reject or cancel any eCoupon and you agree that you will have no claim against us in respect of any rejection or cancellation. Quad-X reserves the right to take any further action it deems appropriate in such instances.

g. Limitation of liability

All offers are subject to availability and while stocks last.

Quad-X shall not be liable to any customer or household for any financial loss arising out of the refusal, cancellation or withdrawal of any eCoupon or any failure or inability of a customer or household to use an e-Coupon for any reason.

h. Miscellaneous

We reserve the right to vary or terminate the operation of any eCoupon at any time without notice.

6. Limited Liability

In no event shall Quad-X be liable for incidental or consequential damages arising out of or in connection with the product. Consequential damages shall include, without limitation, loss of use, income or profit, or losses sustained as the result of injury (including death) to any person, or loss of or damage to property.

7. Cancellations and returns

At quad-x.com we want you to be delighted every time you shop with us. Occasionally though, we know you may want to cancel an order or return items.

All returns will be inspected upon arrival and we will only refund you for the goods if they are in their original condition and are unused. We will refund to you the price you paid for the goods but not the carriage cost. Orders for goods that are made to your specification cannot be cancelled or refunded.

You are entitled to cancel your order/return your goods beginning from the date you placed your order and ending 7 working days after you received the goods. Certain goods are exempt from this, including special order or bespoke items ordered. As a manufacturer we operate a just-in time manufacturing principle and so much of the Quad-X range is in effect produced to each customer's requirements.

Products which do apply to the 7 day return principle include helmets and other rider wear and tyres and rims. If for any reason you are unhappy with your purchase, you can cancel the order/return it to us unused and in its original condition within 7 working days of the day after the date the item was delivered. We regret that this does not apply to products which are produced to your requirements.

If you have not received the goods at the time of cancellation of the contract, and we have not processed the goods for delivery, we will refund to you all the monies paid by you for the goods in question including the delivery charges in the same form of payment originally used for the purchase as soon as possible, and in any event within 30 days of the your cancellation being accepted.

If you have not received the goods at the time of cancellation of the contract, but we have processed the goods for delivery, and they are en route, you must not unpack the goods when they are received by you. You are the owner of the goods once they have been delivered to you and you are liable for their loss or destruction. The goods must be returned to us as soon as possible.

If you have received the goods at the time of cancellation of the contract the goods must be returned to us as soon as possible. We will refund to you the price you paid for the goods but not the carriage cost.

To cancel your purchase within seven days, please go to returns & refunds at the bottom of the screen click on "product returns" and print out a personalised return label for your item, giving the reason for the return. Please package the relevant item(s) securely and send it to us using the personalised return label so that we receive it within seven working days of the day after the date that the item was delivered to you.

All returns will be inspected upon arrival and we will only refund you for the goods if they are in there original condition and are unused.

Please note that we cannot accept returns if you deliver them to us by hand. For your protection, we recommend that you use a recorded-delivery service if the value of the return is more than 50 GBP.

Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. If you are unable to send items back we may be able to arrange for collection of the item from your residence at your cost. Please ensure items are suitably packed. Items delivered on a pallet will need to be palletized when collected. Return packaging is the responsibility of the customer. Where collection is arranged by Quad-X, the responsibility for making goods available for collection remains with the customer. We will endeavour to notify of the day of collection, however we cannot guarantee a specific time. Where collection has been arranged and fails due to the goods not being made available the cost of the aborted collection will be deducted from any refund given.

When returning any petrol powered product all oil and petrol MUST be drained from the engine before you release the goods to a carrier. This is for the safety of the carrier firm.

Cancellation by Us

We reserve the right not to accept any order request if:

we have insufficient stock to deliver the goods you have ordered;
we do not deliver to your area;
one or more of the goods ordered was incorrectly described or priced on the website;
the payment transaction is not authorized;

If we do cancel your contract we will notify you by e-mail and will refund to you any sum paid by you to us in respect of the contract as soon as possible, and in any event within 30 days of the cancellation of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

FREE GIFTS - If a free gift has been provided then it must be returned with item in any of the situations detailed above. If the free item is not returned the full retail value will be deducted from any refund given.

8. Refunds on promotional offers

Refunds for goods purchased under a promotional offer will be based on the terms of the promotional price.Your statutory rights are not affected.

9. Ownership of Goods

All items supplied to the customer remain the property of Quad-X until final payment of all sums owing in respect of those goods has been received in full by us.

10. Excluded Services

The services provided by the quad-x.com Site do not include the provision of computer or other necessary equipment to access the quad-x.com Site. To use the quad-x.com site you will require Internet connectivity and appropriate telecommunication links. We shall not be liable for any telephone or other costs that you may incur.

11. Intellectual property

The content of the quad-x.com Site is protected by copyright, trade marks, database and other intellectual property rights. You may retrieve and display the content of the quad-x.com Site on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Quad-x.com Site without written permission from Quad-x.com.

No licence is granted to you in these Terms and Conditions to use any trade mark of quad-x.com or including, without limitation, the trade marks Quad-X.

12. Limitations

You may not use the quad-x.com Site for any of the following purposes:

disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
gaining unauthorised access to other computer systems
interfering with any other person's use or enjoyment of the quad-x.com Site
breaching any laws concerning the use of public telecommunications networks
interfering or disrupting networks or web sites connected to the quad-x.com Site
making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner

quad-x.com reserves the right to refuse to post material on the quad-x.com Site or to remove material already posted on the quad-x.com Site.

13. Availability of the quad-x.com Site

Although quad-x.com aims to offer you the best service possible, quad-x.com makes no promise that the services at the quad-x.com Site will meet your requirements. Quad-X.com cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to us by email at info@quad-x.com and we will attempt to correct the fault as soon as we reasonably can.

Your access to the quad-x.com Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Quad-x.com will attempt to restore the service as soon as it reasonably can.

14. Quad-x.com's right to suspend or cancel your registration

Quad-X.com may suspend or cancel your registration immediately at our reasonable discretion if you breach any of your obligations under these Terms and Conditions.

The suspension or cancellation of your registration and your right to use the Quad-X.com Site shall not affect either party's rights or liabilities.

15. quad-x.com's liability

The quad-x.com Site is provided by quad-x.com without any warranties or guarantees. You must bear the risks associated with the use of the Internet.

The quad-x.com Site provides content from other Internet sites or resources and while quad-x.com tries to ensure that material included on the quad-x.com Site is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Quad-x.com will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the quad-x.com Site. If quad-x.com is informed of any inaccuracies in the material on the Site we will attempt to correct the inaccuracies as soon as we reasonably can.

In particular, we disclaim all liabilities in connection with the following:

incompatibility of the quad-x.com Site with any of your equipment, software or telecommunications links
technical problems including errors or interruptions of the quad-x.com Site
unsuitability, unreliability or inaccuracy of the quad-x.com Site
inadequacy of the quad-x.com site to meet your requirements

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the quad-x.com Site.

Nothing in this paragraph applies to quad-x.com's liability in respect of products sold through the Online Stores.

16. Third Party Websites

As a convenience to quad-x.com customers, the quad.com Site may include links to other web sites or material which are beyond its control. Quad-x.com is not responsible for content on the Internet or World Wide Web pages on any other site outside the quad-x.com Site.

17. Advertising and Sponsorship

Part of the quad-x.com Site may contain advertising and sponsorship. Advertisers and Sponsors are responsible for ensuring that material submitted for inclusion on the quad-x.com Site complies with relevant laws and codes. We will not be responsible for any error or inaccuracy in advertising and sponsorship material.

18. Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Northern Ireland and any disputes will be decided only by the Northern Irish courts.

19. International Use

Quad-x.com makes no promise that materials on the quad-x.com Site are appropriate or available for use in locations outside the United Kingdom, and accessing the quad-x.com Site from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

20. Expiry Date on Payment Card

Please ensure that the expiry date of your payment card is after the anticipated despatch date of your order. Payment is taken at the point of despatch for goods which are able to be despatched within 14 working days from order. We will endeavor to inform customers if orders are likely to take longer than 15 working days to despatch and will request a 10% deposit with the remainder paid at the time of despatch. In the event that the payment card has expired we will be unable to take payment and fulfil your order.

21. Miscellaneous

You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.

If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.

If you breach these Terms and Conditions and quad-x.com ignores this, quad-x.com will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

Quad-x.com shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.

A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.

22. Limited Warranty Policy

Provided the machine has been serviced in accordance with the service intervals as laid out in the Owner's Manual, Quad-X will repair or replace free of charge any pieces we recognise to be faulty within the warranty period (product specific) following the original purchase. If the part is found by Quad-X to be defective, such parts will at Quad-X's opinion be replaced or repaired at cost to Quad-X.

All parts alleged by the purchaser to be defective must be returned to Quad-X, freight and duties prepaid within the warranty period

Quad-X does not warrant in any way, any product which has been used or is subject to misuse or abuse, mishandling, misapplication, non-original parts have been fitted, neglect (including but not limited to improper maintenance), accident, modification (including but not limited to unauthorised parts or attachments), or adjustment or repair performed by anyone other than Quad-X or an Authorised dealer.

The parties hereto expressly agree that the purchaser's sole and exclusive remedy against Quad-X shall be for the repair or replacement of the defective product as provided in this limited warranty. This exclusive remedy shall not be deemed to have failed of its essential purpose so long as Quad-X is willing and able to repair or replace defective goods.

This limited warranty is in lieu of all other warranties, express or implied, including those of merchantability or fitness for a particular purpose not expressly set forth herein.

Quad-X's liability (whether under the theories of breach of contract or warranty, negligence or strict liability) for its products shall be limited to repairing or replacing parts found by Quad-X to be defective.

Any claim by purchaser regarding this product shall be deemed waived unless submitted to Quad-X within the limited warranty period in writing within the earlier of (i) fourteen (14) days following the date Purchaser discovered, or by reasonable inspection should have discovered, any claimed breach of this limited warranty, or (ii) thirty (30) days following the date of original purchase.

Quad-X will not replace or repair parts that are 1.) Considered to be normal consumable or service parts, and require repair or replacement due to general wear and tear. 2.) Not Mechanical or Electrical parts.

New parts will not be issued until defective parts have been returned as they require inspection to determine the cause of the failure.

Quad-X reserves the right to decline warranty claims at their own discretion.

All returns must be accompanied with the product returns form within 14 days of notification of a problem.

Quad-X is continually improving its products and therefore reserves the right to make improvements or changes when it becomes practical and possible to do so without incurring any obligations to make changes or additions to equipment sold previously.

Time Period: Depending on Product Normally 12 months from original purchase date Labour: Quad-X does not cover cost of labour. Parts: Parts under warranty.

Warranty covers only those parts manufactured by the company and warranty to non-company manufactured parts will be subject to their manufacturer e.g. engine, gearbox, motors, pumps etc.

Where an Engine is fitted the warranty is subject to the engine manufacturer as they have a service network through-out Europe and can better deal with any engine problems, however please contact us for your nearest service centre.
